I highly doubt prosecutors will go forward with this or win this. Khelif is a public figure and put themselves out there in the public eye. I am sure that's a defense in this case. Also the biological sex of Khelif is going to come into play. No way that Musk or Rowling high powered attorneys are going to let that issue slide or call that into question.
Also laws like these aren't sustainable long term. There is no way to regulate everyone's speech and you would locking up half the country and creating a police state. Could you imagine the floodgates something like this would open up for celebrities and public figures to go after the general public. Laws like this were meant for very specific matters like school bullying, and people who aren't public figures or putting themselves out there in a public manner.
They were not meant for issues like a boxer who put themselves on the Olympic stage and their biological sex being questioned. Khelif is a public figure by choice. This is even after the boxer was aware for a year that this issue may come up and knowledge of this persons biological sex.
